These Terms & Conditions ("Terms") govern your use of the FundRaiserZM platform ("Platform") operated by Kaloo Technologies Limited ("we", "us", "our"), a company registered in Zambia. By registering an account, creating a campaign, or making a donation, you confirm that you have read, understood, and agree to be bound by these Terms.
1. Definitions
- "Platform" means the FundRaiserZM website accessible at fundraiser.kalootech.com and any associated mobile applications.
- "Campaign Organiser" means any registered user who creates and manages a fundraising campaign.
- "Donor" means any person who makes a financial contribution to a campaign.
- "Funds" means money collected via the Platform on behalf of a Campaign Organiser.
- "Service Fee" means the 3% fee charged by the Platform on each donation at the point of collection.
- "Disbursement Fee" means the 1.5% fee charged when a Campaign Organiser withdraws collected funds.
2. Eligibility
- You must be at least 18 years of age to create a campaign or register an account.
- Campaign Organisers must be individuals or entities legally resident or registered in Zambia.
- Donors may be of any nationality and are not required to register an account.
- By using the Platform you represent that the information you provide is accurate, current, and complete.
3. Campaign Creation & Management
- Campaign Organisers are solely responsible for the accuracy, completeness, and legality of all campaign content, including titles, descriptions, images, and updates.
- Campaigns must relate to a genuine, lawful purpose. Misrepresentation of a campaign's purpose is strictly prohibited.
- We reserve the right to review, pause, edit, or permanently remove any campaign at our sole discretion, including where we reasonably believe it violates these Terms, applicable law, or is likely to harm donors or third parties.
- Campaign Organisers must post timely updates and respond to reasonable donor enquiries regarding the use of funds.
- You may not operate multiple campaigns for the same purpose without prior written approval from Kaloo Technologies.
4. Prohibited Campaigns & Uses
You may not use this Platform for any of the following purposes:
- Political parties, candidates, or partisan political causes
- Gambling, lotteries, or prize competitions
- Activities that are illegal under the laws of Zambia
- Content that promotes violence, terrorism, hate speech, or discrimination on any basis
- Personal enrichment campaigns with no identifiable beneficiary or outcome
- Campaigns that misrepresent relationships with charities or registered organisations
- Any activity that violates the rights of third parties, including intellectual property rights
5. Payments, Fees & Disbursements
- All payments are processed via Zambia Mobile Money networks (MTN Mobile Money, Airtel Money, Zamtel Kwacha). Donors are charged in Zambian Kwacha (ZMW).
- A 3% Service Fee is added to every donation at the time of collection. This fee covers payment processing costs and platform operations. The donation amount shown to the Campaign Organiser is the amount after this fee has been deducted from the total charged.
- When a Campaign Organiser withdraws funds, a 1.5% Disbursement Fee is deducted from the withdrawal amount to cover the cost of outbound Mobile Money transfers via our payment partner (Lenco).
- Funds are held by the Platform on behalf of the Campaign Organiser until withdrawal is requested. We do not earn interest on held funds.
- Withdrawal requests are typically processed within 1–3 business days, subject to Mobile Money operator processing times.
- We reserve the right to withhold disbursement pending verification if we have reasonable grounds to suspect fraud or misuse.
6. Refunds & Chargebacks
- All donations are voluntary and generally non-refundable once a payment has been confirmed.
- If a campaign is found to be fraudulent or in material breach of these Terms, we will investigate and may, at our discretion, facilitate partial or full refunds to donors.
- Donors who initiate an unauthorised chargeback through their Mobile Money provider may have their access to the Platform suspended.
- To request a refund review, contact us at support@kalootech.com within 14 days of the donation.
7. Intellectual Property
- All Platform software, design, logos, and content created by Kaloo Technologies remain our exclusive property.
- By submitting campaign content (text, images, videos), you grant Kaloo Technologies a non-exclusive, royalty-free licence to display, reproduce, and promote that content on the Platform and in related marketing materials.
- You warrant that you own or have the right to use all content you submit, and that it does not infringe the rights of any third party.
8. Privacy
The collection and processing of personal data is governed by our Privacy Policy, which forms part of these Terms. By using the Platform you consent to the practices described therein.
9. Limitation of Liability
- The Platform is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation.
- Kaloo Technologies is a technology platform intermediary. We do not endorse, verify, or guarantee any campaign, and are not responsible for how funds are used by Campaign Organisers.
- To the maximum extent permitted by applicable Zambian law, our total liability to any user shall not exceed the total fees paid by that user to the Platform in the 12 months preceding the claim.
- We are not liable for indirect, consequential, incidental, or punitive damages of any kind.
10. Suspension & Termination
- We may suspend or terminate your account at any time for violation of these Terms, suspected fraud, or at our reasonable discretion with notice where practicable.
- Upon termination, any pending verified withdrawal balance will be disbursed to you after deduction of applicable fees, provided no investigation is ongoing.
- You may close your account at any time by contacting support@kalootech.com.
11. Governing Law & Disputes
These Terms are governed by the laws of the Republic of Zambia. Any disputes shall first be resolved through good-faith negotiation. If unresolved, disputes shall be referred to the courts of Zambia with jurisdiction in Lusaka.
12. Changes to These Terms
We may update these Terms from time to time. We will notify registered users via email or in-platform notice at least 7 days before material changes take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
